x. 4 key essential t&cs

1. primary purpose of rental - all items requested can solely be designated to press and creative use. please be aware that any commercial usage including any form of direct advertising or marketing projects, is not permitted as the borrower, we kindly ask that you use all items provided solely for the purpose initially agreed upon.

2. item delivery - as the borrower, we kindly request that you cover all shipping costs. this can be done either by organizing it yourself or through a courier service. we will specify the courier, based on our extensive experience. please ensure that you provide a parcel-tracking service, and be certain to handle any necessary tax documents or related requirements if requesting from outside the european union.
as mentioned above please always feel free to ask us for support if you need help in the process.

3. publicity, credits & acknowledgement - as the borrower, we ask that you credit ‘julia bajanova’ in any image releases, whether they’re shared on the internet or in print. this applies to all platforms, including social media, websites, and any other media, globally and indefinitely.
additionally, we ask that you inform us about any new image releases. please share links to any online publications or print materials within 14 days of publication. please send this information to the following email: releases@juliabajanova.com (or previously used contacts).

4. handling - all pieces provided are handcrafted and unique. as the borrower, it’s your responsibility to maintain their condition. please make sure to inspect all items upon receipt and report any damages or losses immediately. for any alterations to the items, prior approval is strictly necessary. keep in mind that excessive wear or damage could result in additional charges.

a. primary purpose of rental

1. purpose – the borrower agrees to use the item(s) solely for the purpose specified in a manner which is consistent with the intended and previously declared use and project.
any additional use will require prior written approval.

any item can solely be used for non-commercial press and/or creative purposes. any use of any item for commercial purposes is restricted (e. g. using lent items in brand-campaigns, online-shops, or as a backdrop to promote another designer or brand; in particular external jewelry-, shoe-, or accessory-designers/brands). such use will result in a contractual penalty determined in ‘section e’ below.

2. duration – the rental period starts on the moment the item(s) are handed over to the borrower and ends on the date where all items are returned to julia bajanova.

3. ownership of items – all items remain in full property of julia bajanova at all times. the borrower is responsible for the items from the time of delivery until it is returned to julia bajanova.

b. item delivery

please note that we have to process a lot of loans and therefore have limited capacities available. therefore, we kindly ask you to ensure the following:

– for self-arranged pickups & returns:
the borrower is responsible for coordinating the pickup and return of the item(s) directly with us, the loan giver. please make sure to arrange your own pickup and return in consultation with us well in advance.

– for courier-facilitated pickups & returns (dhl/ups/fedex or similar):
